App/Cloud Terms, User Agreement / Privacy Policy


1.0 GENERAL
1.1. By installing the Application (as defined below), you agree to be bound by these terms of use (“appterms”). Please review them carefully before installation and/or acceptance.

2.0 DEFINITIONS
2.1. The “Application” shall mean the software provided by PlanetM1.net to offer services to be used on Android OS devices and Apple iOS devices and any upgrades from time to time and any other software or documentation which enables the use of the Application.
2.2. The “CloudServer” or “Cloud” shall mean the software running on the cloud server to offer the service over the internet.

3.0 CONDITIONS OF USE
3.1. You will not, nor allow third parties on your behalf to (i) make and distribute copies of the Application (ii) attempt to copy, reproduce, alter, modify, reverse engineer, disassemble, decompile, transfer, exchange or translate the Application; or (iii) create derivative works of the Application of any kind whatsoever.
3.2. You acknowledge that the terms of agreement with your respective mobile network provider (‘Mobile Provider’) will continue to apply when using the Application. As a result, you may be charged by the Mobile Provider for access to network connection services for the duration of the connection while accessing the Application or any such third party charges as may arise. You accept responsibility for any such charges that arise.
3.3. If you are not the bill payer for the mobile telephone or handheld device being used to access the Application, you will be assumed to have received permission from the bill payer for using the Application.

4.0 SERVICE PROVIDER
4.1. PlanetM1 is an authorized M1 Cloud Service Provider Partner for the Elk / Ness M1.

5.0 CHARGES
5.1. You are responsible for payment of any costs or expenses incurred as a result of downloading and using any PlanetM1 application or service including any operator network and roaming charges. Please check with your service provider for details.
5.2. Our applications and services are licenced not sold.
5.3. A licence is mapped to a single Elk / Ness M1 panel (Cloud Account ID) or single service only.
5.4. Each Elk / Ness M1 (Cloud Account ID / M1XEP) connecting to our cloud is required to purchase a licence, for that system from either Google Play or Apple's App Store with an in-app purchase or non-renew subscription within the M1 Touch Cloud app.
5.5. All payments need to be made in advanced before the service is activated and can be used.
5.6. All payments are final and no pro-rata refunds is given for early termination of your service.
5.7. It's the customers responsibility to renew the service at the end of the service expiry using the M1 Touch Cloud.
5.8. The service is not automatically renewed at the end of the service expiry.
5.9. Prices or connection plans may change with or without notice.
5.10. Correct prices will show in the app.

6.0 CLOUD ID
6.1. Your M1 Cloud Account ID can only be registered to one (1) cloud service provider at a single time.
6.2. Your M1 Cloud Account ID can only be assigned to one (1) main/master PlanetM1 Cloud account at a single time.
6.3. The M1 Cloud Account ID allows monitoring and controlling the system, and does not provide ElkRP access via the cloud.

7.0 THIRD-PARTY APPLICATIONS, SERVICES OR SITES
7.1. This app may enable you to a link or connect you to use functionalities of third-party applications, services or sites that are not owned or controlled by PlanetM1.net. Any third Party applications are subject to the terms and conditions of the relevent thrid party provider. PlanetM1.net has no control over and is not responible or liable for any matters relating to your dealing or transactions with such thrid parties and over any thrid-party content, syndicated content, applications, services, sites, advertisements, links, privacy policies and/or practices of any such third-parties that my be accessible via this application.

It is your resoniblity to check the privacy policies and terms to service and usage of all thrid party sites that you visit prior to downloading or using any such third party application or service.

8.0 TRACK AND REPORTING
8.1. PlanetM1.net reserves the right to anonymously track and report, to our third-party statistical service providers, your activity in any of our applications.

9.0 AVAILABILITY
9.1. The Application is available to handheld mobile devices running Android OS Operating Systems, or Apple iOS Operating Systems.
9.2. The M1 Cloud Service is available to all customers who is using M1XEP (Ethernet Module) firmware 2.0.42 and above.

10.0 SYSTEM REQUIREMENTS
10.1. In order to use the Application, you are required to have a compatible mobile telephone or handheld device, internet access, and the necessary minimum specifications ('Software Requirements').
10.2. The Software Requirements are as follows: Android OS devices running Android OS version 4.1 and above; Apple Device running iOS OS version 8 and above; Language: English.
10.3. The version of the Application software may be upgraded from time to time to add support for new functions and services.
10.4. Not all devices may have access to all functions of the app, due to nature of hardware and software requirements to make those functions work.

11.0 TERMINATION
11.1. PlanetM1.net may terminate use of the Application at any time with or without notice of termination to you.
11.2. If your agreement is terminated you must remove the application from your device.
11.3. Once the service or application is terminated then your licence is also terminated.

12.0 LIMITATION OF LIABILITY
12.1. In no event will PlanetM1.net be liable for any direct, indirect, special, punitive, exemplary or consequential losses or damages of whatsoever kind arising out of your use or access to the Application or Services, including loss of profit or the like whether or not in the contemplation of the parties, whether based on breach of contract, tort (including negligence), product liability or otherwise.
12.2. PlanetM1.net is not liable to you for any damage or alteration to your equipment including but not limited to computer equipment, handheld device, hardware on site, or mobile telephones as a result of the installation or use of the Application.
12.3. Nothing in these terms / appTerms shall exclude or limit PlanetM1.net liability for death or personal injury caused by negligence or for fraud or fraudulent misrepresentation or any other liability which cannot be excluded or limited under applicable law.

13.0 DISCLAIMER OF WARRANTIES
13.1. To the maximum extent permitted by law, and for the avoidance of doubt, save for section 2 of the Supply of Goods and Services Act 1982, PlanetM1.net hereby disclaims all implied warranties with regard to the Application or Service. The Application, Service and software are provided "as is" and "as available" without warranty of any kind.

14.0 TECHNICAL SUPPORT
14.1. Our technical support is only provided during Australian business hours (Melbourne / Sydney time zone).
14.2. Only email support is offered. Phone or internet based call support is not available.
14.3. We only provide support on the app and cloud service, and not the security panel hardware or programming or routers/modems.
14.4. Technical support is only available to customers who download the app from the Google Play Store or Apple App Store.
14.5. Technical support is provided at no extra cost while you have an active service with us.
14.6. Technical support should be sent to the email address support@planetm1.net.
14.7. On a case by case basis, we may request remote login support to your computer to run diagnostics software to help find problems.

15.0 CLOUD
15.1. All cloud software is written or approved by PlanetM1.net.
15.2. Our cloud software is not available for sale, rent or given for free.
15.3. Our cloud server is hosted in a secure cloud data center.
15.4. We have the right to suspend the cloud server while we upgrade our cloud software with or without notice.

16.0 NOTIFICATIONS
16.1. It's the customers responsibility to check there email inbox or any spam boxs for emails that our cloud server might of sent.
16.2. Push notifications are sent as soon as an event occurs. There could be delays from Google or Apples servers during busy times.
16.3. PlanetM1 is not reliable if any push notifications, or if any email notifications that are not recevied once left our server(s).
16.4. It's the customer responsibility to have a good working mobile signal or internet connection for the notifications to be recevied.

17.0 PROMOTIONAL CODE
17.1. The promotional code can be used only once, unless otherwise specified.
17.2. The promotional code is not transferrable and may not be resold.
17.3. The promotional code is valid for a limited time only.
17.4. The promotional code have no monetary value, and cannot be exchanged for cash.
17.4. The promotional code cannot be issued as part of any competition(s) unless given approval by PlanetM1.
17.5. Promotional codes are only redeemable within the 'M1 Touch Cloud' app for Android and iOS only.
17.6. PlanetM1 has the right to terminate, restrict, suspend, change, or cancel the promotional code at any time without prior notification.


Privacy Policy

The M1 cloud App (M1 Touch Cloud) provides a way to control your Elk / Ness M1 panel over a cloud connection.

You can remotely control your panel from your mobile device, at any time and any location while you have an active internet connection.

Our Privacy Policy explains how we use and protect the information in relation to services.

1 – Necessary Information:

To access the service you are required to provide the following user data:
1a. Your name
1b. Email address
1c. Username and Password
1d. Timezone and Country

Additional details may be required in the future.

2 – What we do with the information:

The information provided is not sold or accessable by any 3rd party, and is only stored on the PlanetM1 Cloud server.

We will only use the details provided to help identify you, and so you can connect and control systems on your cloud account.

When required, we may share data with trusted partners to help identify any issues we detect.

The information is required to be able to setup, create and register your user account on the PlanetM1 cloud server.

Details provided may also be used for PlanetM1 to contact you when required, and to send surveys when required.

3 – Billing and Payments:

Payments by the end user is handled by Google Play as an in-app purchase.

Payment tokens from Google Play is sent to the PlanetM1 Cloud server to verfiy the payment after the payment is complete.

Please refer to the Google Play Billing Privacy Policy on how Google Play collects and processes payments.

We have no responsibility or liability for the delection of, or the failure to store or transmit, any content and other information maintained or transmitted by any of our applications. We are not reponsible for the accuracy or reliablility of any information or advice transmitted through any of our applications.

We may at any time, limit your use or discontinue this applcation at our sole discretion. To the extent legally permitted, in no event shall we be liable for any losses or damages whatsover. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitation or exclusion may or apply to you. In no event shall our total liability to you exceed the amount actually paid by you (if any) for the application, service and related software.

The app Terms & User Agreement may be updated at any time with or without notice, and is valid for all versions of the application & all upgrades to our cloud software regardless when you signed up and activated your service.

By using our applications and services you agree to the above terms & user agreement.
